The female of the species is nearly identical in external morphology to the male, with the only notable difference being the more prominently pointed and elevated casque located atop the upper mandible.
This species is native to Siam (present-day Thailand).According to local accounts, the bird nests within natural cavities formed in decaying trunks of large trees. After laying eggs, the male remains inside the nest to incubate, while the female forages for food outside. Once the chicks have hatched, the male continues to reside in the nest to care for the young. During this period, the female seals the entrance of the nesting cavity with mud, leaving only a small aperture through which she delivers food to the male and the chicks. When the chicks are sufficiently developed and capable of flight,the female breaks open the sealed nest entrance, allowing the male to lead the fledglings out of the cavity.
Local inhabitants, upon discovering such nests, often take measures to protect them.

Frizzle Chicken

This fowl possesses black pupils, with irides displaying a reddish-yellow hue, and yellowishwhite orbital rings. The cheeks are light red, and the beak is yellow-white in color. The comb is pale red, and the wattles (feshy appendages hanging from behind the comb) are marked with fine bluish-red speckles. The entire plumage is pure white. Notably, the feather shafts exhibit reversed growth orientation, curving outward from the body, creating a frizzled appearance. Both wing and tail feathers also curl outward in a similar fashion.The legs are yellowish-white, the claws are black, and the spurs (bony projections on the legs used in fighting) are white.Among individuals of this breed, white-feathered specimens are the most common.
During the summer months,the bird undergoes significant feather molting, often appearing nearly bald, with only hollow feather shafts remaining visible.New feather growth begins in late autumn, with full development of flight feathers and tail feathers completed by winter.
According to the Guangzhi (《廣志》 a book on natural history), “There exists a type of chicken with reversed wings."”The Guihai Yuheng Zhi(《桂海虞衡志》,Well-balanced Records of Guihai) elaborates:"The Frizzle Chicken grows remiges in a reversed orientation, curling outward. This breed is exceptionally tame and docile, rarely straying from human contact, and is found in both Guangxi and Guangdong regions." The Bencao Jijie ( 《本 草集解》a book on herbal medicine )quotes Qiankun Shangye(《乾坤商業(yè)》), stating: "The reversed-feathered chicken can be used to treat reflux-related ailments?" However, the commentary notes that the so-called “reversed-feathered chicken" refers specifically to the frizzle type, whose remiges grow outward. The therapeutic claim is classified as metaphorical or symbolic in nature,based on the principle of analogy, rather than empirical efficacy.The Wulei Xianggan Zhi(《物類相感志》)records:“When juvenile chickens that have not yet grown wing feathers are driven with a broom, their feathers may grow in reverse—though this only affects the wings. However, there is a distinct variety of chicken in which all body feathers, from head to tail, naturally grow in a reversed direction—this is the Frizzle Chicken."

Also known historically as Shui'e(水號),DiaoJi (雕),and BaiJue(白).
This bird is native to regions north of the capital (Beijing), specifically beyond the mountain passes. It is slightly smaller than the common domestic chicken, yet displays markedly vivid and ornate plumage. Its eyes have black pupils, with irises showing a dark bluish-black halo and pale ochre-white orbital rings. The upper eyelids are overlaid with a patch of red skin. The chin and cheeks are earthy yellow, sprinkled with fine bluish-grey spots. Three to four tufts of black feathers protrude from beneath the lower jaw.The crown is dark bluish-black; the neck is a muted yellow, marked with interspersed black and yellow spots. Near the nape, black feathers exhibit faint horizontal yellow-white bands, which are succeeded by a patch of pure black feathers with emerald green fringes. The feathers near the tail are dusky red with black overtones, displaying a metallic sheen. The shoulder feathers are yellowish with black shading, interspersed with black and white spots. The wings show alternating black and white patterns; feather bases are white while tips are bluish-black. The breast is predominantly black, overlaid with fine yellow markings. The lower abdomen is solid black, transitioning to pure white near the vent area. The tail is black and bifurcated into two lobes, with delicate linear white markings along the feather edges. The legs are short and feathered; the toes and claws are bluish in colour.
Despite its striking appearance and richly coloured plumage, the meat of this bird is coarse in texture and considered unpalatable, thus it is not favoured for consumption.
Although only twenty-nine names areformally titled inVolumeVIof theImperiallyQinding Niao P u (《欽定烏譜》 Commissioned Bird Albums), archival records from the Qing court indicate that each volume was originally intended to contain thirty illustrations.Based on this discrepancy, it is inferred that the Spruce Grouse (KouBeiShuJi represents anuntitled but extant thirtieth illustration,likely corresponding to the second of the “two varieties of tree-fowl" (Shu Ji).Acording to the order adopted by imperial painters Yu Xing and Zhang Weibang, who replicated Jiang Tingxi's original paintings during the Qianlong reign, the twentieth plate is labelled “Tree Fowl" (Shu Ji), suggesting that the twenty-first should be identified as the“Spruce Grouse."

This bird features black pupils with irises surrounded by a reddish-black halo. Both the orbital ring and the beak are bright red.The cheeks are white, while the lower jaw is grey.A narrow black feathered stripe runs from the base of the beak to above the eye, and a larger patch of black feathers extends from behind the eye toward the upper chest. The neck is short. From the crown of the head to the back, wings, and tail, the plumage is uniformly reddish-brown. The chest is coloured a bluish-brown, while the abdominal feathers are bluish-grey with interspersed black and yellow markings forming distinct patterns. The legs are short and red,and the claws are dark bluish-black.
The Jushan Zaji(《居山雅記》,Miscellaneous Records from Mountain Dwelling) records: "In the months of May and June, a species known as the Shi Ji (stone chicken) may be observed in the mountains. It resembles the domestic chicken in form but is smaller, with a red beak and brownish body. Its plumage is delicate and visually appealing, and its call resembles that of a domestic chicken, though louder. It is believed to be the same as the bird referred to as DengJi()in Bencao”Bencao Gangmu(《本草網(wǎng)目》,Compendium of Materia Medica) likewise notes:“The Deng Ji belongs to the rail (Rallidae) family. Males are brown in colour, while females exhibit mottled plumage. Their vocalizations are remarkably loud, though they disappear by the autumn months."

Grey Heron

This species is also historically referred to by the names Qing Han (青韓) and Xin Tian Yuan (信天緣).
The Grey Heron is described as having black pupils surrounded by a yellow-tinged iris. The bill is yellow, with a bluish-red tint at the base, and feathers extend from the beak base across the cheeks. The crown is off-white (milky white), with several elongated black filamentous plumes emerging from above the eyes, the longest of which reach three to four cun (approximately 10{-}12~cm ). The neck, nape, breast, and belly are uniformly off-white. A distinct pointed black spot is located on the chest, and elongated hanging plumes are present on the belly. The back is bluish in coloration and covered with loosely arranged scapular feathers resembling a cloak. The upper wing coverts are bluish-white, while the primary and secondary flight feathers are blue-black. The remiges are relatively short and show alternating yellow and black colouring. The tail feathers, wings, and flight feathers together form a layered covering over the posterior of the bird, producing an overall greyish-yellow appearance. The tibiotarsus and tarsus are elongated and slender, and the claws are alternatelyblack and yellow.
According to Mingwu Beikao(《名物備考》),"The Qing Zhuang(Grey Heron) resembles the egret in general form but is larger in size. Its body is bluish-grey; the crown bears black plumes, and a tuft of white ornamental feathers hangs from the chest. Because of its distinct and well-patterned plumage, it is also called ‘Qing Han':" Bencao Gangmu ( 《本草 目》, Compendium of Materia Medica) further records: “among waterbirds, there is a type referred to as Xin Tian Yuan (Follower of Heaven's Will). It stands motionless for extended periods, seldom changing position, and waits for fish to pass before striking. It is temperamentally tranquil and physically dignified, hence it is named Zhuang’ (, meaning composure or solemnity). This is the same species commonly known as Qing Han."

This species is described as having black pupils surrounded by a yellowish iris with a diffuse halo.The orbital ring is composed of concentric yellow and green tones. The bill is slender and sharply pointed. The upper facial region is black, while the lower portion is yellow. A crest of long, blue-black filamentous feathers extends from the crown of the head.The neck is notably elongated and slender. The dorsal plumage, including the back, lower back, and wings, is predominantly bluish-grey, with light blue mottling appearing across the upper back. Long feathers near the tail and on the flanks beneath the wings exhibit alternating yellow and white coloration, forming a distinct gradation of plumage tones. The tips of the wings bear conspicuous white circular spots; the primary fight feathers are black with contrasting white tips. The feathers extending from the throat to the abdomen are white in base colour, overlaid with pale blue-gey streaking. The legs are long and elevated; the anterior surface of the tibiotarsus is greenish, while the posterior aspect is reddish-ochre (described as “millet red"). The claws are black and strongly hooked, resembling those of raptorial birds. For this reason, the species is colloquially referred to as “Shui Ying" (水鷹).

The Great Bustard is described as having black eyes and a black beak.The crown is covered in bluish-grey feathers with interwoven pale red and bluish patterns. The neck, nape, and upper chest are uniformly bluish-grey, while the lower abdominal plumage is slightly lighter, tending toward white. The dorsal feathers are yellow at the base, overlaid with bluish-grey shading and transverse black markings of varying thickness, arranged irregularly to resemble the pattern of a leopard’'s coat. The scapulars are bluish-grey; the wings are black; and the tail feathers are yellow, patterned with black spots. The legs are bluish-grey, and the claws are black.A notable anatomical feature is the absence of hind toes.
According to the Piya (《坤雅》), a classical lexical commentary citing Guo Pu,“The bustard resembles a wild goose in form. It lacks a hind toe and bears pattern marked like that of a leopard, hence it is also called Du Bao' (貓豹 solitary leopard). When attacked by birds of prey, it is said to expel faeces as a defensive mechanism and may shed its feathers to facilitate escape".A Fujianese proverb states:"The bustard has no tongue, and the rabbit has no spleen."This implies that the bustard either lacks a prominent tongue or has one fused to the floor of the mouth.Its toes are connected, and it lacks the ability to perch effectively. The species is largely terrestrial and avoids arboreal habitats. In Shuowen Jiezi (《文解 字》), the graph for “島” is explained as follows:" ‘Seventy’ in sequence"—constructed from the characters for seven(\pm)and ten(+).This denotes the orderly movement of birds in coordinated groups, which aligns with the bustard’s observed behaviour of communal foraging and flight. The Shi Jing (《詩經(jīng)》 The Book of Songs) also references this pattern with the phrase “Bustards march in formation" (行),underscoring the same behavioural motif. Bencao Gangmu(《本草網(wǎng)目》,Compendium of Materia Medica)describes the bustard as:“"A water bird resembling a goose, with mottled plumage and no hind toe. It is not inclined to perch in trees. Its flight is calm and deliberate, and when feeding,it makes a grinding sound. The bird is large and fat, rich in body fat, with coarse but flavourful meat, and is suitable for consumption."

12.Coloured gems.It is common practiceforgemstonestobe treatedinordertoenhancecolour andclarity.Unlessstatedbuyers shouldpresumecolouredstones maywellhavebeenexposedto somesortoftreatment.

3.Bidding procedures and the Buyer
3.1.Youmustregisteryourdetails withusbeforebiddingandprovide uswithanyrequestedproofof identityandbillinginformation, inaformacceptabletous(more details aresetout atParagraph[13] oftheInformationforBuyersinthe auctioncatalogue).Wereserve the right,wherewedeemweareso requiredforregulatorypurposes, torevealyouridentityandcontact details(andthoseofyourPrincipal) totheSeller.Youmustalsosatisfy anysecurityarrangementswe haveinplacebeforeenteringthe auctionroomtovieworbid.
3.2.Westronglyrecommend that youattendtheauctioninperson ifpossible.You areresponsiblefor yourdecisiontobidforaparticular Lot.If you bid on a Lot,including by telephoneandonlinebidding, orbyplacingacommissionbid, weassumethatyouhavecarefully inspectedtheLotandsatisfied yourselfregardingitscondition.
3.3.lf you instruct us in writing, wemayexecutecommission bidsonyourbehalf.Neitherwe norouremployeesoragentswill beresponsibleforanyfailureto executeyourcommissionbid, unlessourfailuretodosois unreasonable.Wheretwoormore commissionbidsarerecordedat thesamelevel,wehavetherightto preferthefirstbidmade(wherethis canbereasonablyascertained).
3.4.The Bidder placing the highest bidforaLotacceptedbythe AuctioneerwillbetheBuyerat the Hammer Price.However,the Auctioneershallretaindiscretion ontherunningoftheauctionand inparticular,retains theright not toacceptabidandtoprefera bidoveranyotherbidsreceived atthesametime.Anydispute aboutabidwillbesettledatour discretion.WemayreoffertheLot during the auction ormaysettle the dispute inanotherway.Wewillact reasonablywhendecidinghowto settlethedispute.
3.5.Bidderswillbe deemed to actasprincipals(inotherwords, actingfortheirownaccountand notonbehalfofsomeoneelse), evenif theBidder isactingas an agentfora thirdparty.
3.6.WemaybidonLotsonbehalf oftheSelleruptoonebidbelow theReserve.
3.7.Wemayrefusetoacceptany bid if it isreasonablefor us to do SO.
3.8.Biddingincrementswillbe atoursole discretion(butwill beinlinewithstandardauction practice).
3.9.In the event you participate in theauctionusingtheservicesof an IndependentBiddingPlatform, youwillincuranadditionalfeeor additionalcommissionpayableto thatplatform.Thiswillbecollected byusaspartoftheTotalAmount DueintheeventyouaretheBuyer of theLoton which youbid.

4.Thepurchase price
4.1.As Buyer,you will pay:
a.theHammerPrice;
b.aPremium of 26% up to20,000 (31.2% inclusive ofVAT), 25% from 20,001-500,000( 30% inclusive ofVAT), 20% from 500,001 thereafter 24% inclusiveofVAT)of theHammerPrice;
c.anyartist'sresalerightroyalty identifiedaspayableonthesaleof theLot;
d.anyadditionalbiddingfee payablebyaBuyerbiddingviaan IndependentBiddingPlatform;and
e.anyVATdue.
5. VAT
5.1.You shall be liable for the payment of anyVATapplicable on theHammerPriceandPremium duefora Lotandonanyfeepayable pursuant toClause4.1.dabove. Please see the symbolsused in theauctioncatalogueforthatLot and the“Information for Buyers” in our auction catalogue forfurther information.
5.2.WewillchargeVATatthe currentrateatthedateofthe auction.
5.3.Foranyitemssoldunderthe rulesfortheAuctioneers'Margin Scheme,VATatthestandardrate willbechargedonthePremiumat thestandardrate.ThisVATcannot beitemisedseparatelyonour invoicesandisnotreclaimableby UKVATregisteredSellers.
6.BuyerWarranties
6.1.Youwarrant,andwhereyouare actingonbehalfofsomeoneelse, youwillprocurethatyourPrincipal warrants,that:
6.1.1.thefundstobeusedfor thepurchaseoftheLot(s)arenot connectedwithnorarederived fromanycriminalactivity,including withoutlimitationtaxevasion, money laundering or terrorist financing;
6.1.2.neitheryou,nor any agent actingforyou,noryourPrincipal are to thebestofyourknowledge either under investigation,nor haveyoubeenchargedwithor convictedofwithoutlimitation tax evasion,money laundering, terroristfinancingorothercriminal activities;and
6.1.3.neitheryou,nor any agent actingforyou,noryourPrincipal, aresubjecttoRestrictiveMeasures orowned,partlyownedor controlled by person(s) subject to suchRestrictiveMeasures.
6.2.Whereyouarebiddingon behalfofanotherperson andyou arean Art Market Participant, youwarrantthat:(i)youhave conductedappropriatecustomer duediligenceontheultimateBuyer of theGoodsin accordancewith allapplicableMoneyLaundering Legislation;(i) upon request,you willprovideusoranyindependent thirdpartyauditor(employedatour cost)withanyidentificationand anyotherrelevantdocumentation youhaveobtainedforcustomer duediligencepurposesonthe ultimate Buyerof the Goods;(ii) youconsenttousrelyingonthis due diligence;and(iv)you will retainforaperiodofnotlessthan fiveyearsthedocumentation evidencing the duediligence.
6.3.Whereyouarebiddingon behalfofanotherpersonandyou arenotaregulatedArtMarket Participant,you warrant thatyou willprovide accurateandcomplete informationaboutyourPrincipalto us.
7.Thecontractbetweenyouand theSeller
7.1.Thecontractfor thepurchase oftheLotbetweenyouandthe Sellerwillbeformedwhen the hammerfallsacceptingthehighest bid for the Lot at the auction.
7.2.You may directly enforce any termsintheTermsofConsignment againstaSellertotheextentthat yousufferdamagesand/orlossas aresultoftheSeller'sbreachofthe TermsofConsignment.
7.3.IfyoubreachtheseTermsof Sale,youmayberesponsiblefor damages and/orlossessufferedby aSellerorus.Ifwearecontacted byaSellerwhowishestobring aclaimagainstyou,wemayin ourdiscretionprovidetheSeller with informationor assistancein relationtothatclaim.
7.4.Wenormallyactasan agentonlyandwillnothaveany responsibilityfordefaultbyyouor theSeller(unlesswearetheSeller of the Lot).
7.5.Inadditiontoanyotherrights wemayhavetocancelacontract forsaleundertheseTermsofSale, wemaydelaycompletionofasale, delayreleaseofaLotorcancelthe saleofaLotintheevent:
7.5.1youareinbreachofyour warrantiesinClause6;or
7.5.2wehavenotcompletedour enquiriespursuanttotheMoney LaunderingLegislationtoour satisfaction;or
7.5.3wehavereasontobelievethat thetransactionmightbeunlawful foranyreason,orthatthesale mightputusunderanycivilor criminalliability.
8.Payment
8.1.Immediatelyfollowingyour successfulbidonaLotyouwill:
8.1.1.give tous,if not already providedtooursatisfaction,proof ofidentityinaformacceptable tous(andanyotherinformation thatwerequireinordertocomply with our anti-money laundering obligations pleasereferto Paragraph13oftheInformationfor Buyers in the auction catalogue); and
8.1.2.pay tous theTotalAmount Dueinanywaythatweagreeto acceptpayment(forcash,there isanupperlimitof10,000euros equivalent).
8.2.lfyou oweusanymoney,we mayuseanypaymentmadebyyou torepaythemoneyyouoweus.
9.Titleandcollectionofpurchases
9.1.Whileyouareboundbythe contractforthepurchaseoftheLot fromthefallofthehammeronyour successful bid,the transaction is notcompletedandownershipin theLotwillnotpasstoyouuntil:
9.1.1.youhavepaidusinfull the TotalAmountDueinclearedfunds forthat Lot;
9.1.2.youhaveprovideduswith theinformationsetoutinClause 8.1.1; and
9.1.3.wehavecompletedour enquiriespursuanttotheMoney LaunderingLegislation to our satisfaction.
9.2.Youmaynotclaimorcollect a Lot until (i)you have paid forit, (i)ownership haspassed toyou and(i)any applicable storage chargeapplicableunderClause 9.4and accruedupuntil theday ofcollectionhavebeenpaidin fullbyyou(atlaw,therightfora professionaltoholdontogoods untilitsserviceshavebeenpaid for is called a“l(fā)ien").
9.3.Unlessnotifiedotherwise, andsubject tothe passing of ownershipintheLottoyouunder Clause9.1,youwill(atyourown expense)collect anyLots thatyou havepurchasedandpaidforeither:
9.3.1.not laterthan5workingdays followingthedayofthe auction;or
9.3.2.notlater than5 working days following the date thatwe havereceivedpaymentof theTotal Amount Due in cleared funds,if later.
9.4.SubjecttoClause 9.1,ifyou do notcollectaLotyouhaveagreed topurchasewithinanyofthetime periodssetoutatClause9.3above, weshallstartchargingaminimum warehousingchargeoff5per Lotper dayplusanyapplicable VAT,startingfromthelatestofthe timeperiodssetoutatClause9.3 abovetoexpire.Youwillalsobe responsibleforanyreasonable removalandinsurancechargesin relationtothatLotunlessthedelay wascausedbyus.
9.5.Riskofloss ordamage to theLotwillpasstoyouwhenyou (oryouragents)takephysical possessionoftheLot.
9.6.Subject toClause 9.1,ifyou donot collect theLot that you have paidforwithinninetydaysafterthe auction,wemaysell theLot.We willpaytheproceedsofanysuch sale to you,but (unless the delay was caused by us) will deduct any storagechargesorothersumsthat wehaveincurredinthestorageand saleoftheLot.Wereservetheright to chargeyoua sellingcommission atourstandardratesonanysuch resaleoftheLot.
10.Remediesfornon-paymentor failuretocollectpurchases
10.1.PleasedonotbidonaLotif youdonotintendtobuyit.Ifyour bidis successful,these Terms ofSaleformyourcontractof purchase.Thismeansthatyou will havetocarryoutyourobligations setoutintheseTermsofSale. Ifyoudonotcomplywiththese Terms ofSale wemay (actingon behalfoftheSellerandourselves) pursueoneormoreofthefollowing measures:
10.1.1.take action against you for damagesforbreachofcontract;
10.1.2.reversethesaleoftheLot toyouand/oranyotherLotssoldby us to you;
10.1.3.resell theLotby auction or privatetreaty(inwhichcaseyouwill havetopayanydifferencebetween thepriceyoushouldhavepaidfor theLotandthepricewesell itfor aswellasthechargesoutlinedin Clause9.Pleasenotethatifwesell theLotforahigheramountthan yourwinningbid,theextramoney will belongtotheSeller;
10.1.4.remove, store and insure theLotatyourexpense;
10.1.5.ifyoudonotpayus within threeworkingdaysofyour successful bid,we may charge interestataratenotexceeding 1.5% permonthonthetotal amountdue;
10.1.6.keepthatLotoranyother Lotsoldtoyouuntilyoupaythe TotalAmountDue;
10.1.7.reject or ignore bids from youoryouragentatfutureauctions orimposeconditionsbeforewe acceptbidsfromyou;and/or
10.1.8.ifwesellanyLotsforyou, usethemoneymadeontheseLots torepayanyamountyouoweus.
10.2.Wewill actreasonablywhen exercisingourrightsunderClause 10.1.We will contactyoubefore exercisingtheserightsandtryto workwithyoutocorrectanynoncompliancebyyouwiththese TermsofSale.
11.Healthandsafety
Althoughwetakereasonable precautionsregardinghealthand safety,you are on our premises atyourownrisk.Pleasenote thelay-outofthepremisesand securityarrangements.Neitherwe norouremployeesoragentsare responsibleforthesafetyofyou oryourpropertywhenyouvisit our premises,unless you suffer any injurytoyourpersonordamage to your property as aresult of our, ouremployees'orouragents negligence.
12.Seller'sWarranties
12.1.TheSellerwarrants tousand toyou that:
12.1.1.theSeller is the true owner oftheLotforsaleorisauthorised bythetrueownertoofferandsell theLotatauction;
12.1.2.theSelleris able to transfer goodandmarketabletitletothe Lot toyoufreefromanythirdparty rightsorclaims;and
12.1.3.asfaras theSelleris aware, themaincharacteristicsoftheLot setoutintheauctioncatalogue(as amendedby anynoticedisplayed inthesaleroomorannouncedby theAuctioneeratthe auction),and anydocumentationprovidedto youbytheSellerinrelationtothe Lot, are correct.
12.2.If,afteryouhaveplaced a successfulbidandpaidforaLot, anyofthewarrantiesaboveare found nottobe true,please notify usinwriting.Neitherwenor the Sellerwill be liabletopayyou any sumsoverandabovetheTotal AmountDueandwewillnotbe responsibleforanyinaccuracies intheinformationprovidedbythe Sellerexceptassetoutbelow.
12.3.Pleasenotethatmanyof theLotsthatyoumaybidonat ourauction are second-hand.If aLotisnotsecond-handandyou purchasetheLotasaConsumer froma Seller that isa Trader,a number of additional terms may beimpliedbylawinadditionto theSeller'swarrantiessetoutat Clause 12.1 (inparticular under theConsumerRightsAct2015). TheseTermsofSaledonotseek toexcludeyourrightsunderlawas theyrelatetothesaleoftheseLots.
12.4.Saveasexpresslysetout above, allother warranties, conditionsorothertermswhich mighthaveeffectbetweenthe Sellerandyou,orusandyou,orbe impliedorincorporatedbystatue, commonlaworotherwiseare excluded.
13.Descriptions,condition and safety
13.1.OurdescriptionsoftheLot willbebasedon:(a)information providedtousbytheSellerofthe Lot(for which we are not liable); and(i)ouropinion(althoughitis likelythatwewillnotbeableto carryoutadetailedinspectionof eachLot).Theactualcolourofthe Lotmayvaryfromtheimagesinthe auction catalogue.
13.2.We will give you a number of opportunitiestoviewandinspect theLotsbeforetheauction.You (andanyindependentconsultants actingonyourbehalf)mustsatisfy yourself abouttheaccuracyofany descriptionofaLot.Weshallnot beresponsibleforanyfailureby youoryourconsultantstoproperly inspectaLot.
13.3. Representations or statementsby us as to authorship, genuineness, origin, date, age,provenance,condition or estimatedsellingpriceinvolve mattersofopinion.Weundertake thatanysuchopinionwillbe honestlyandreasonablyheldand accept liabilityfor opinionsgiven negligentlyorfraudulently.
13.4.Pleasenote that manyof the Lotsthatyoumaybidonatour auctionaresecond-handandare unlikelytobeinperfectcondition. Lots are sold“asis"(i.e.asyou see thematthetimeoftheauction). NeitherwenortheSelleraccept anyliabilityfortheconditionof second-handLots,fortheirfitness forpurpose,or for anycondition issuesaffectingaLotifsuchissues areincluded inthedescriptionofa Lotin theauction catalogue(orin any saleroomnotice)and/orwhich theinspectionofaLotbytheBuyer oughttohaverevealed.
13.5.ThesaleofLotscontaining elephantivoryisbanned,subject tosomeexceptions.Wherewe offer Lots containing elephant ivoryfromtimetotime,werely onthedocumentationobtained by theSelleroftheLotconfirming thattheLotsatisfiestherelevant exemptions.We cannotguarantee thatanycertificateorother documentationprovidedbyus (on the Seller's behalf) to you in connectionwiththesaleoftheLot isvalidoraccurate.
13.6.AllLotswithelectrical components aresold as“antiques” fortheirhistoricalanddecorative attributesforcollectionand displayonly,andarenotintended foruse.lf you buy Lots with electricalcomponentsandintend touse them,you must first ask aqualified electrician to check themforcompliancewithsafety regulations.
13.7.AllLotsoffurniturearesold asacollector'sitemfordisplay purposesandarenotsuppliedfor use.SuchLots maynot comply withapplicablefurnitureandsafety regulations.Therefore,ifyou do intendtousesuchLotsforprivate useorotherwise,youmustfirst ensurethattheyarerefurbished andrenderedcompliantwithany applicablefurnitureandsafety regulations.
14.DeliberateForgeries
14.1.You may return any Lot which youconsiderwithsomecausetobe aDeliberateForgerytouswithin21 daysoftheauction,providedthat youreturntheLottousinthesame conditionaswhenitwasreleased toyou,accompaniedbyawritten statementidentifyingtheLotfrom therelevantcataloguedescription andawrittenstatementofdefects.
14.2. If we are satisfied,acting reasonably,that the Lot isa DeliberateForgeryandithasbeen returnedtouswithinthetime specified inClause 14.1,wewill refundthemoneypaidbyyoufor the Lot(includinganyPremium and applicableVAT)PROVIDEDTHAT youwillhavenorighttoarefund underthisClause14.2if:
14.2.1.the catalogue description reflectedtheacceptedview ofexpertsasatthedateofthe auction;or
14.2.2.youpersonally arenotable totransfergoodandmarketable titleintheLottous.
14.3.IfyouhavesoldtheLotto another person,wewillonlybe liabletorefundthepricethat youpaidfortheLot.Wewill not beresponsiblefor repaying anyadditionalmoneyyoumay havemadefromsellingtheLot. TherightsunderthisClause14 aregiventoyouasBuyerinour auction;theyarenotgivento,and maynotbetransferredorassigned to,any third party.
14.4.YourrighttoreturnaLot thatisaDeliberateForgerydoes notaffectyourlegalrightsandis inadditiontoanyotherrightor remedyprovidedbylaworbythese TermsofSale.
15.OnlineOnlyTimedAuctions
Thesefollowingtermsare applicableonlytosalesconducted onlineonlyandaretobeusedin additiontotheconditionsofsale.
(a)Right to Cancel (i)lfyouareaconsumerresident intheEuropeanUnionyouhave therighttocancelthecontract forthepurchaseofalotwithin14 calendardayswithoutgivingany reason.
(ii)The cancellationperiodwill expireafter14calendardaysfrom thedayonwhichyouacquire(ora partynominatedbyyouandisnot the shipper)physical possession of thelot.
(ii)To exercise theright to cancel, youmustinform usofyourdecision tocancelthiscontractbyaclear writtenstatement(e.g.alettersent bypost,faxoremail),oryoumay usethecancellationformwhich canbefoundonourwebsiteorby contactingamemberofstaff.The communicationmustbereceived within14calendarsdaysfromthe dayonwhichyouacquirethelot.
Roseberysnorthesellerwillbe responsibletoyouforerrorsduring oraftertheonlineonlytimed auctionorfailurestoexecutebids placedontheinternetoronyour mobile device,including,without limitation,errorsorfailurescaused by:
(i)anylossofconnectiontothe auctionbeingconductedonline;
(i)abreakdownorproblemswith the onlinebiddingsoftwareor the websiteserviceprovider;and/or
(ii)abreakdownorproblemswith anyinternetconnection,computer, mobiledeviceorsystem.
16.Our liabilitytoyou
16.1.Wewillnotbeliable foranylossofopportunityor disappointmentsufferedasaresult ofparticipatinginourauction.
16.2.Inadditiontotheabove, neitherwenortheSellershallbe responsibletoyouandyoushall notberesponsibletotheSelleror usforanyotherlossordamage thatanyofussufferthatisnota foreseeableresultofanyofusnot complyingwiththeConditions ofBusiness.Lossordamage is foreseeableifitisobviousthatit willhappenorifatthetimeofthe sale of the Lot,we,you and the Sellerknewitmighthappen.

17.2.Any notice referred in Clause
16.1 may be given:
17.2.1.by delivering it byhand;or
17.2.2.by first class pre-paid post orRecordedDelivery;or
17.2.3.byemail,provided thata copyisalsosentbyfirstclassprepaidpostorRecordedDelivery. Anoticegivenbyemailwillbe deemedtobesignedforthe purposesof thisClause16.1if the nameofthesenderappearsina signaturepositionafterthebodyof theemailandhasnotbeenadded automaticallybythesender's emailserver.
17.3.Noticesmust besent:
17.3.1.byhand,byfirst class pre paidpostorRecordedDelivery:
a.tous,atour address setout intheseTermsofSaleoratour registeredofficeaddressappearing onourWebsite;and
b.toyou,atthelastpostaladdress thatyouhavegiventousasyour contactaddressinwriting;or
17.3.2.by email:

19.General
19.1.We may,actingreasonably, refuseadmissiontoourpremises orattendanceatourauctionsby anyperson.
19.2.Weactas anagent for our Sellers.Therightswehavetoclaim againstyouforbreachofthese Termsof Salemaybeusedby eitherus,ouremployeesoragents, ortheSeller,itsemployeesor agents,asappropriate.Otherthan assetoutinthisClause18.2,these TermsofSalearebetweenyou and usandnootherpersonwillhave anyrightstoenforceanyofthese TermsofSale.
19.3.Wemayusespecialterms inthecataloguedescriptionsof particular Lots.Youmustread thesetermscarefullyalongwith anyglossaryprovidedinour auctioncatalogues.
19.4.EachoftheClausesofthese TermsofSaleoperatesseparately. Ifanycourtorrelevantauthority decidesthatanyofthemare unlawful,the remaining Clauses willremaininfullforceandeffect.
19.5.WemaychangetheseTerms ofSalefromtimetotime,without noticetoyou.Pleasereadthese TermsofSalecarefully,astheymay bedifferentfromthelasttimeyou readthem.
(iv)If you cancel the contract, wewillreimburseallpayments received fromyou.AsRoseberys areunabletoprovideapostage orpackingservicethecostofthe initialdeliveryorcollectionisnot returnable.Inaddition thecostof returningtheitemifyouchooseto cancel the contract is payable by you.
(v)Wemaymakeadeduction from thereimbursementforloss invalueofanygoodssupplied,if thelossistheresultofdamaged caused by unnecessary handling whilstinyourpossession.Wewill makethereimbursementwithout unduedelay,andnotlaterthan (aa)14calendardaysafter the daywereceivebackfromyouany goods supplied,or (bb)(if earlier) 14calendardays afterthedayyou provideevidencethatyouhave returned thegoods.
(vi)We will make the reimbursementusingthesame meansofpaymentasyouused for the initial transaction,unless you have expressly agreed otherwise;in any event,you will notincuranyfeesasaresultof the reimbursement.Wemaywithhold reimbursementuntilwehave receivedthegoodsbackoryou have supplied evidence of having sentbackthegoods,whicheveris earliest.
(b) Liability
16.3.You should note thatLots are soldasantiquesfortheirdecorative attributesratherthanforuse,and areoftenofconsiderableageand uncertainmanufacture;neitherwe northeSelleracceptsanyliability for lossor damage to theLots,or anyotherlossordamage,that is caused byorresults from any inherentvice or defect affecting the Lots.
16.4.SubjecttoClause15.4,ifwe arefound tobe liabletoyouforany reason(including,amongstothers, if we arefound tobe negligent,in breachofcontractortohavemade amisrepresentation),ourliability willbelimitedtothetotalpurchase pricepaidbyyoutousforanyLot.
16.5.Notwithstanding the above, nothingintheseTermsofSale shalllimitourliability(orthatofour employeesoragents)for:
16.5.1.death or personal injury resulting fromnegligence(as defined in the Unfair Contract Terms Act1977);or
16.5.2. fraudulent misrepresentation;or
16.5.3.any liability which cannot beexcluded by law.
17.Notices
17.1.Allnoticesbetweenyouand usregardingtheseTermsofSale mustbeinwritingandsignedby or clientservices@roseberys.co.uk b.toyou,bysending thenotice to anyemailaddressthatyouhave giventousasyourcontactemail address in writing.
17.4.Noticeswill bedeemed to havebeenreceived:
17.4.1.if delivered byhand,on the day of delivery;or
17.4.2.if sent by first class prepaidpostorRecordedDelivery, two business days after posting, exclusiveofthedayofposting;or
17.4.3.ifsentbyemail,atthetime oftransmissionunlesssentafter 17.00intheplaceofreceiptin whichcasetheywillbedeemed tohavebeenreceivedonthenext businessdayintheplaceofreceipt (providedthatacopyhasalsobeen sentbypre-paidpostorRecorded Delivery as set outin Clause16.3.1.
17.5.Anynoticeorcommunication givenundertheseTermsofSalewill notbevalidlygivenifsentbyfax, anyformofmessagingviasocial media ortextmessage.
18.DataProtection
Wewill hold andprocess any personal data inrelation to you inaccordancewithourcurrent privacypolicy,a copyof which is availableonourwebsite.
19.6.Exceptasotherwisestated intheseTermsofSale,eachofour rights andremediesare:(a)arein additiontoandnotexclusiveof anyotherrightsorremediesunder theseTermsofSaleorgeneral law;and(b)maybewaivedonlyin writingandspecifically.Delayin exercisingornon-exerciseofany rightundertheseTermsofSaleis notawaiverofthatoranyother right.Partial exerciseofanyright undertheseTermsofSalewill notprecludeanyfurtherorother exerciseofthatrightoranyother rightundertheseTermsofSale. Waiverofabreachofanytermof theseTermsofSalewill notoperate asawaiverofbreachofanyother termoranysubsequentbreachof thatterm.
19.7.TheseTermsofSaleandany disputeorclaimarisingoutoforin connection with them (including anynon-contractualclaimsor disputes)shallbegovernedbyand construedinaccordancewiththe lawsofEnglandandtheparties irrevocablysubmittotheexclusive jurisdictionoftheEnglishcourts.
